BIDDER'S CONTRACT: TERMS & CONDITIONS OF THIS AUCTION:  All bidder's agree to be bound by this contract when saying "yes" in placing a bid: PLEASE SCROLL & READ ALL TERMS LISTED BELOW, INCLUDING PREVIEW. 

BOERNE ISD SURPLUS PORTABLE CLASSROOM AUCTION SPECIAL TERMS AND CONDITIONS FOR THE PORTABLE CLASSROOM/BUILDING TO BE MOVED AT, Fair Oaks Ranch Elementary School,  1. The successful bidder must obtain all permits required by any state or local government authority for the removal of the structure located at 29085 Ralph Fair rd. Fair Oaks Ranch, TX. 78015. The successful bidder shall have 60 calendar days from the date his or her bid was accepted at auction (60 days counted beginning the first day after the date on which the bid was accepted). Proof of all required permits must be delivered to Mr. Mark Stahl, Boerne ISD, no later than 3 p.m. on the 30th day as calculated above. 2. The structure and all debris must be removed within 60 calendar days from the date of the successful bid (60 days beginning the first day after the date on which the bid was accepted). The site shall be left clean and free of all debris. All posts, pillars, and foundation elements shall be removed and the sight shall be leveled uniformly although no fill will be required of the successful bidder. All gas, electric and other utility connections shall be left in a neat and secured condition according to state and local codes and this condition is included in all references to the term “clean up”. 3. The successful bidder shall deposit with Boerne Independent School District the sum of $500.00 to assure the satisfactory removal and clean up of the portable classroom/building from 29085 Ralph Fair Rd. Fair Oaks Ranch, TX. 78015. The successful bidder must remove the structure in its entirety. Upon satisfactory cleanup of the site, the Boerne ISD will release the $500.00 to the successful bidder without further claim. The account containing the deposit shall be created in the names of both the successful bidder and the Boerne ISD. The Boerne ISD shall have no claim to the deposit other than to assess against the deposit any costs incurred by the Boerne ISD to clean and secure the lot if the successful bidder fails to do so. The money shall be deposited with Security State Bank within 48 hours after the successful bid is confirmed by the auctioneer. In the event that the cleanup of the lot by the successful bidder is unsatisfactory to the Boerne ISD, the Boerne ISD will present to the bidder a written list identifying the work that needs to be done. The list will contain charges that have been determined by the Boerne ISD to be necessary to clean up the site and secure the remaining utilities, if any. The bidder will then have 7 calendar days in which to comply with the list and perform the necessary cleanup. The failure of the bidder to comply with any item on the list will automatically entitle the Boerne ISD to deduct the cost of such item from the amount of the deposit. 4. The successful bidder shall acknowledge and agree to these terms by signing this document.

All items must be paid and removed by designated pickup date.  DYNAMIC CLOSING/TIME LEFT: If a bid is entered within the last three minutes (180 seconds) of the closing of an item, the closing time will be extended by three minutes (180 seconds) to ensure sufficient time for bidders to submit their bids.  Dynamic Closing will continue until no bids are placed within 3 minutes.

1. PAYMENT: Please pay online with M/C, Visa & Discover in your “Dashboard” under “Invoices” section under.  If paying in Cash, you may pay when you pick up your items at auction location.  No checks.

2. PICK UP TIME / REMOVAL:  Please see footer on each item for this information. ALL ITEMS MUST BE PAID FOR AND REMOVED BY THIS TIME, NO EXCEPTIONS.  All items must be paid and removed by designated pickup date.  

3. Any items left remaining, either paid or unpaid after this time (end of checkout/removal) will be abandoned and forfeited, but buyer is still under contract to pay.

4. Ten percent buyer’s premium added to bid at invoice.

5. Sales tax will be collected on taxable items at the appropriate sales tax rate unless you have filled out a valid Texas Resale Exemption form with us. You may scan & email your signed form to:  auctioneer@texasbid.com .  We must have this on file in order to exclude sales tax from your purchases on your final invoice before the auction closes.  

6. All items sold "As-Is, Where Is", no warranty or guarantee of any kind. All sales are final. All descriptions are believed to be accurate, however, all bidding and buying is based solely on bidder's personal inspection and/or opinion of the items.    It is the Bidder/Purchaser’s sole responsibility to:   (a)  perform all inspections of the items and to be satisfied as to its description, condition and/or authenticity prior to bidding.   (b)  independently verify any information they deem important including information available.   (c)  All information contained in the item description and all promotional materials, including, but not limited to, photographs, dimensions, conditions, etc., was provided by or on behalf of the Seller and is believed to be correct; however, neither the Seller nor the Auction Company makes any promise, representation, guarantee, or warranty as to the accuracy or completeness of such information.   (d) Failure to inspect the property does not relieve bidder of responsibility for payment and removal as stated in these terms.

7. All Bids Are A Binding Contract.  Bidder acknowledges that once a bid is offered, the Bidder shall be bound by the bid amount. Bids can’t be withdrawn or retracted.  Verify your information entered (ie: bid amount) before submitting your bids.  Bidder agrees that by placing a bid on any item that they agree to be bound by this bidder's contract & agreement for auction terms & conditions.

8. Buyer is responsible for providing the supplies (boxes, packing material, tools & equipment, etc.) necessary, as well as the physical labor for dismantling, rigging, crating, loading and hauling at there own expense.     Buyer is responsible for the items once bidding is complete.  Auctioneers & Office Staff are not available for load out.

9. Items subject to additions and or deletions prior to sale time/closing.  

10. TexasBid makes no warranty that: (a) your use of the site will be uninterrupted, timely, secure, or error-free, (b) the results that may be obtained from the use of the site will be accurate or reliable, (c) the quality of any information or other material obtained by you through the site will meet your expectations, (d) the use or the inability to use the site; unauthorized access to or alteration of your transmissions or data; statements or conduct of any third party on this site; or any other matter relating to the site.

11. In case of any errors or malfunctions of hardware or software, TexasBid reserves the right to cancel any transaction even if you have received confirmation of the transaction by email.  We reserve the right to postpone or reopen the auction for any reason including, but not limited to, technical difficulties, service outages, etc. We strive to make this system as stable as possible; however errors and equipment malfunctions are possible and may happen without notice.       We cannot and will not guarantee uninterrupted access to the Site or its services.

12.  Bidder agrees that by placing a bid on any item that they agree to be bound by this bidder's contract & agreement for auction terms & conditions. Forres Meadows Auctioneers, Inc. dba TexasBid.com reserve the right to terminate bidders privileges immediately or at any time for violation of this bidders contract. * DYNAMIC CLOSING/TIME LEFT: If a bid is entered within the last three minutes (180 seconds) of the closing of an item, the closing time will be extended by three minutes to ensure sufficient time for bidders to submit their bids.  Dynamic Closing will continue until no bids are placed within 3 minutes.   Individuals previewing items are personally responsible for any breakage/damage to items they are handling and will be charged appraised value for item(s). (You break it, You buy it.)   All people previewing assume all responsibility for their own safety.  Auctioneer & Seller are not responsible for accidents.
